This company is a non-governmental publisher of labor law compliance posters. Posters are solicited by phone and direct mail. Solicitations used by the company appear to be sent by a government entity or other municipality and generally have the layout and illustration of an invoice. The company is not associated with any State or Federal government agency. Businesses are not required as implied in the solicitation, to submit any information requested, or pay any money to receive employment posters. Title 39, United States Code, Section 3001, makes it illegal to mail a solicitation in the form of an invoice, bill, or statement of account due unless it conspicuously bears a notice on its face that it is, in fact, merely a solicitation. This disclaimer must be in very large (at least 30-point) type and must be in boldface capital letters in a color that contrasts prominently with the background against which it appears. The disclaimer must not be modified, qualified, or explained, such as with the phrase "Legal notice required by law." It must be the one prescribed in the statute, or alternatively, the following notice prescribed by the U.S. Postal Service: THIS IS NOT A BILL. THIS IS A SOLICITATION. YOU ARE UNDER NO OBLIGATION TO PAY THE AMOUNT STATED ABOVE UNLESS YOU ACCEPT THIS OFFER.
While it is true that some of the statutes and regulations enforced by the U.S. Department of Labor (DOL) require that notices be posted in the workplace, these posters can be obtained free of charge by contacting the DOL, or visiting their website at www.dol.gov/compliance/topics/posters. The website has an elaws Poster Advisor which can be used to determine which posters employers are required to display. Posters are available in English and other languages, and can be downloaded and printed directly from the Advisor.
