Additional Complaint Information

Complainants allege unauthorized credit or debit card charges, false advertising, failure to honor their money back guarantee, and inability to obtain refunds. Other customers complain the product does not work as advertised, or that disclosures regarding the terms and conditions of the offer are unclear or that company representatives attempt to verbally change the conditions when contacted by customers to request refunds or credits. Some complainants allege after returning products for refunds, the company issues only partial refunds. Others complain that although they are promised refunds, the company fails to send them. The company responds to some complaints by agreeing to issue full or partial refunds, disputing allegations, or offering explanations or clarification of their policies, terms and conditions. Some complainants dispute that they actually receive the promised refunds. Allegations of unauthorized charges and false advertising were generally not addressed.

Industry Tips
This company sells the Zyatrim weight loss product via infomercial and internet sales via a free trial offer with a 100% money back guarantee. The company claims the product is a European formula that kills fat cells without muscle loss. The trial offer advertisied as "free" is conditional upon purchasing products offered with a 60 day money back guarantee. Their guarantee states that if you don't like the product for any reason you can return the bottle within 60 days of your purchase date for a full refund of the bottle price.

We urge caution. Before agreeing to trial offers or giving your credit card number to unfamiliar companies with unfamiliar products get all details of the offer in writing. Although this company's offer is advertised as free, the charge imposed for shipping and handling of the product, actually makes the offer NOT free. Once your credit card number has been provided to cover shipping and handling, it will remain on file with the seller for shipping and billing purposes. If you forget to cancel, or for any reason fail to do so, your card number is readily available for billing of additional shipments of their product.

Although the company's website may make cancellation procedures appear fast and easy, in reality customers report that cancellation requests are ignored, calls are not returned, credit cards continue to be charged, and unwanted product shipments continue to arrive.

This company's free trial is conditional upon accepting their offer for additional product. FTC Guidelines for advertising this type of offer require that all terms and conditions of the offer, as well as cancellation instructions, be clearly and conspicuously displayed in at least 10 point type before asking for payment or obtaining the customer's consent. Clearly and conspicuously means, NOT disclosed in microscopic print accessed by a web blink to another site, but rather, disclosed along with the free trial solicitation. Regardless, many consumers overlook the advisories or disclosue statements, and are unaware of unauthorized charges or debits until their next monthly credit card statement.

Industry guidelines require marketers to provide a fast easy method of canceling, either by mail, phone, or website, Failure to do so may be a violation of consumer protection laws. Most credit card issuers will allow the cardholder 60 days to dispute an unauthorized or inaccurate charge. Review your monthly statement carefully. If you discover a charge which is unfamiliar, investigate and dispute the amount with your card issuer as soon as possible to protect yourself from making unwanted purchases.
